I sure got me some good readin' this week. Here are a few excerpts. Enjoy!

From a car accident case:

"We bear in mind that unchecked obsequiousness to an abstract rule can produce inaccurate and unjust results, the very banes [the statute] seeks to avoid."


From the case of the 6'5", 250 lb. male basketball player who accidentally broke a high school girl's arm while guarding her at practice:

"We do not see how the young man in question could be classified as
equipment, supplies, materials, facilities or resources."


This from the Aquila family reunion, which ended up in a lawsuit between cousins:

"Intentional tackling is not a customary part of the sport or activity of [potato] sack racing."

and

"It is clear from the record that this "roughhousing" between two grown men was done in a spirit of childlike competition between cousins, which unfortunately due to their respective ages and physical limitations, may negligently have caused some serious damage."
